Electoral Petitions : Ruling Within 10 Days

Section 131 of the Electoral Code provides the timeframe in which the Constitutional Council has to rule on a petition on the rejection or acceptance of a candidacy.

The electoral process is at the pre-electoral disputes phase. Following the publication of candidacies accepted by the Electoral Board of ELECAM on July 26, some petitions have been filled at the Constitutional Council. At the close of the two-day deadline for the filling of petitions after the publication of the list as stated in Section 129 of the Electoral Code, the Constitutional Council now has to rule on the petitions. Indeed, Section 131 gives the judicial institution a timeframe on 10 days to give a judgement on the petitions brought before them. “In the case of objections or petitions relating to the rejection or acceptance of candidacies as well as those relating to the colour, initials or emblem chosen by a candidate, the Constitutional Council, before which the matter is brought, shall rule within no more than 10 days of the filling of the petition,” stipulates the Electoral Code. 
The deadline for the filling of petitions was July 28, 2025 at midnight. A total of 35 petitions were recorded at the office of the Registrar-in-Chief of the Constitutional Council. Going by the 10 days deadline, the institution thus has till August 7 to give a reasoned ruli...
